U.S. for the use of Carter v. Freedom Demolition, Inc., 2009 WL 3838558 (M.D.Ga. November 13, 2009) followed the opinion of another judge of the same court reported at U.S. for the use of Roc Carter Company, LLC v. Freedom Demolition, Inc., 2009 WL 3418196 (M.D.Ga. October 14, 2009) and held that there was no Miller Act jurisdiction over the case because the military housing project on land leased by the Government was not a public work of the United States.
